There's some truth to parts of this - but also some inaccuracy.
It is true, according to Snopes.com, that the U.S. Equal Employment Opportunity Commission ruled that a complainant who said that a Postal Service co-worker's wearing a Gadsden flag cap - which depicts a coiled rattlesnake and the phrase "Don't Tread on Me" - constituted race-based harassment had met the legal standard to state a claim, and the complaint should therefore be investigated.
